This Privacy Policy describes how photoFit, Inc. ("photoFit," "we," "us," or "our") collects, uses, shares, and protects your personal information when you visit photofit.click (the "Site") or interact with our services. This policy is governed by the laws of the State of California, United States.

California Residents: You have specific rights under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA). See Section 10 for a full description of your rights and how to exercise them.

1. Information We Collect

We collect the following categories of personal information:

a) Information You Provide Directly

Contact Data: Email address provided when joining our waitlist or contacting us.
Measurement Photographs: Images you voluntarily submit for the purpose of garment fitting. These images are treated as sensitive personal data (see Section 3).
Communications: Any messages or feedback you send to us.

b) Information Collected Automatically

Usage Data: IP address, browser type, operating system, referring URLs, pages visited, and timestamps.
Cookies and Tracking Technologies: We use cookies, web beacons, and similar tools to operate and improve our Site. See Section 7 for full details.
Device Data: Device identifiers and general geographic location derived from IP address.

c) Sensitive Personal Information (as defined under CPRA)

Photographs used for body measurement extraction may constitute sensitive personal information under California law. We process this data solely to provide our tailoring service and do not use it for any secondary purpose, including advertising profiling.

2. How We Use Your Information

We use your personal information only for the following purposes:

To operate and improve the photoFit service.
To process photographs and extract body measurements for custom garment production.
To send you product launch updates and communications you have opted into.
To respond to your inquiries and provide customer support.
To comply with applicable legal obligations.
To detect, prevent, and address fraud, security incidents, or technical issues.

        Strict Internal Use Policy: We do not sell, rent, share, or trade your personal information to third parties for their own marketing or advertising purposes, under any circumstances.
    

3. Data Retention & Photo Deletion

We follow a strict data minimization approach:

Photographs: Original images are processed by our AI system to extract numerical measurement coordinates. Photographs are permanently and irreversibly deleted within 24 hours of successful processing. If processing fails, photographs are deleted immediately upon detection of the failure.
Measurement Data: Only the resulting numerical coordinates (e.g., inseam, waist circumference) are retained for the purpose of fulfilling current and future orders.
Email Addresses: Retained until you unsubscribe or request deletion.
Usage & Log Data: Retained for up to 90 days for security and operational purposes, then deleted or anonymized.

Upon your request, we will delete all personal data associated with your account within 45 days, subject to any legal retention obligations.

4. How We Share Your Information

We do not sell your personal information. We may share your data only in the following limited circumstances:

a) Service Providers (Data Processors)

We work with vetted third-party vendors who process data solely on our behalf and under our instructions:

All service providers are contractually prohibited from using your data for any purpose beyond the services they provide to us.

We may disclose your information if required to do so by law, court order, or governmental authority, or where we believe in good faith that disclosure is necessary to protect our rights, prevent fraud, or protect the safety of users or the public.

c) Business Transfers

In the event of a merger, acquisition, or sale of substantially all of our assets, your personal information may be transferred. We will notify you via email and/or a prominent notice on our Site prior to your data becoming subject to a different privacy policy.

5. Email Communications

By joining our waitlist, you consent to receive product launch updates and related communications from photoFit.

Right to Opt-Out: You may unsubscribe at any time by clicking the "Unsubscribe" link in any email or by contacting us at privacy@photofit.click.
Opting out of marketing emails does not affect transactional communications related to any active order or account.

6. Security

We implement industry-standard administrative, technical, and physical safeguards to protect your personal information, including:

TLS encryption for all data in transit.
Encryption at rest for stored personal data.
Role-based access controls limiting data access to personnel who require it for production purposes.
Regular review of our data collection, storage, and processing practices.

While we take reasonable steps to protect your information, no method of transmission over the internet is 100% secure. We cannot guarantee absolute security.

Data Breach Notification

In the event of a data breach that is reasonably likely to result in harm to affected individuals, we will notify affected users and relevant California authorities in accordance with the California Consumer Privacy Act and California Civil Code § 1798.82, within the timeframes required by law.

7. Cookies & Tracking Technologies

We use the following types of cookies and tracking technologies on our Site:

You can manage or disable non-essential cookies through your browser settings. Note that disabling certain cookies may affect the functionality of the Site. 8. Children's Privacy (COPPA)

Our service is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe your child has provided us with personal information, please contact us immediately at privacy@photofit.click and we will promptly delete that information.

Users between the ages of 13 and 17 may use the service only with verified parental or guardian consent.

9. Links to Third-Party Sites

Our Site may contain links to third-party websites. We are not responsible for the privacy practices of those sites and encourage you to review their privacy policies independently.

10. California Privacy Rights (CCPA / CPRA)

If you are a California resident, you have the following rights under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA):

Right to Know: You may request disclosure of the categories and specific pieces of personal information we have collected about you, the sources of that data, our business purpose for collecting it, and the categories of third parties with whom we share it.
Right to Delete: You may request deletion of personal information we have collected from you, subject to certain exceptions (e.g., legal obligations).
Right to Correct: You may request correction of inaccurate personal information we hold about you.
Right to Opt-Out of Sale or Sharing: We do not sell or share your personal information for cross-context behavioral advertising. No opt-out is required, but you may contact us to confirm.
Right to Limit Use of Sensitive Personal Information: You may request that we limit our use of your sensitive personal information (including body measurement photographs) to only what is necessary to perform the requested service.
Right to Non-Discrimination: We will not discriminate against you for exercising any of your privacy rights.

We will respond to verifiable consumer requests within 45 days. We may extend this period by an additional 45 days when reasonably necessary, with prior notice. We will not charge a fee for processing your request unless it is excessive or repetitive.

You may authorize an agent to submit a request on your behalf by providing written authorization. We may require verification of your identity before processing requests.

11. Governing Law

This Privacy Policy is governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from this policy shall be subject to the jurisdiction of the courts located in California.

12. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. When we make material changes, we will:

Update the "Last Updated" date at the top of this page.
Notify waitlist subscribers via email at least 14 days before changes take effect.
Display a notice on our Site for at least 30 days following a material change.

Your continued use of the Site after the effective date of any changes constitutes your acceptance of the updated policy.
